Service Continuity Policy
This Policy sets out what happens to a subscriber’s access, data and prepaid Fees if Halcyon Waters sp. z o.o. discontinues Cayø Largo or a material part of it. It forms part of the Agreement under § 18 paragraph 8 of the Terms of Service. Where it conflicts with § 7, § 16 or § 18 of the Terms, this Policy prevails. Capitalised terms have the meaning given in the Terms.
1Scope
- 1.This Policy applies to every User holding an active paid subscription to the Services, including the Core, Pro and Alpha plans and the 30-day pilot.
- 2.Discontinuation means a decision of the Company to stop providing the Services, or a Material Part of them, to Users generally. It includes a decision taken because continued provision is no longer commercially viable or technically feasible, and the voluntary winding-up or liquidation of the Company.
- 3.Material Part means any part of the Services included in the User’s plan whose withdrawal materially reduces the data available to the User, unless the Company replaces it with equivalent data.
- 4.Discontinuation Date means the date stated in the notice under section 2 from which the Services, or the Material Part, are no longer provided.
- 5.This Policy does not apply to suspension or termination for the User’s breach, non-payment, suspected fraud or misuse, or sanctions and AML grounds under § 18 paragraph 2 points 1 to 3 of the Terms. It does not apply to ordinary changes to the Services that do not amount to a Discontinuation.
2Notice
- 1.The Company shall give each User at least 60 days’ written notice of a Discontinuation, by e-mail to the address registered for the User’s Account. The notice states the Discontinuation Date and how the export under section 3 will be delivered.
- 2.Where a Discontinuation is required by law, a regulator or a court, or follows the Exchange ceasing to make its market data available, the Company shall give as much notice as the circumstances allow. Sections 3, 4 and 5 apply in full in that case as well.
- 3.Until the Discontinuation Date the Services remain available to the User on the terms of its subscription, to the extent this is within the Company’s control.
3Data Export
- 1.Within 30 days of the notice, and in any case before the Discontinuation Date, the Company shall make available to the User a complete export of the data its plan entitles it to on the date of the notice: every field of the plan, at the plan’s sampling cadence, over the plan’s full history depth, for every covered coin. In the case of a Material Part, the export covers that part.
- 2.The export is delivered as Apache Parquet files with a data dictionary matching the API documentation, through a time-limited signed download link, or in another format agreed with the User in writing.
- 3.The download link remains available for at least 30 days. The export is free of charge.
- 4.Where a force majeure event under § 16 of the Terms prevents delivery within these periods, the Company shall deliver the export as soon as practicable after the event ends.
4Continued Licence
- 1.Notwithstanding § 18 paragraph 3 point 3 of the Terms, the User may retain and use, perpetually and for its own internal purposes, all Licensed Materials it lawfully obtained up to the Discontinuation Date, including the export under section 3.
- 2.All other restrictions of the Agreement continue to apply to those Licensed Materials, in particular the prohibitions on redistribution, resale, sublicensing and the building of competing products.
5Prepaid Fees
- 1.The Company shall refund the prepaid Fees attributable to the period after the Discontinuation Date, pro rata by day, within 30 days of the Discontinuation Date, to the account from which they were paid. In the case of a Material Part, the refund is proportionate to the reduction in the Services agreed with the User in writing.
- 2.The refund under this section is not subject to § 7 of the Terms on non-refundable Fees. It is not subject to the aggregate liability cap in § 16 of the Terms and does not count towards that cap.
6Changes to this Policy
- 1.The Company shall not amend this Policy to the detriment of a User during that User’s current Subscription Term. Such amendments apply to the User from its next renewal.
- 2.Questions about this Policy may be sent to enquiries [at] halcyonwaters [dot] com.
- 3.This Policy applies from 2026-10-29.
